what is my legal rights for a seperation not divorce

You have none, you are either married or not married, there is no in between. Texas does not recognize legal separations. After a divorce is filed Temporary Orders can be issued to handle such things as who can live in the house, how much child support should be paid, what the visitation schedule is, who pays which debt, etc. You need to talk to a good family law attorney.
