Re: Legal Separation in Texas

Texas does not recognize a "legal separation."

What it does have is a partition agreement dividing

property by agreement without a formal divorce.

Such an agreement has very stringent requirements

and should not be attempted without an attorney. If

child custody is an issue, no formal legal method

except divorce exists. Obviously, parents often will

work out their own arrangements outside of the courts,

but enforceability of such arrangements by the courts

is questionable at best.
