Ms. Bushman is correct; you need to speak with a competent family law attorney to help you get this sorted out.

In the short term the attorney would probably advise you to obtain Temporary Orders from the Court to establish the rights and responsibilities of both you and your husband until the divorce is finalized.

If the house was bought during the marriage, it is community property. In other words, you both own it. Ultimately one of you can keep the house and pay about half the equity to the other to buy out the second spouses interest or you can sell it and split the proceeds.

Based upon the 22 year length of your marriage and the fact that you have not worked during that time you are quite likely entitled to spousal maintenance (alimony) so that you have some income until you can get on your feet.

If you have children you will need to resolve the child custody and child support issues.

Best wishes,

Art

You need to go talk with a good family law attorney in your area. Surprisingly, many will meet with you the first time without charge or for a minimal fee. Good luck!
