Legal Question in Family Law in Texas

..ok I'm still legally married, bout 4 years ago I moved out of my house cuz things were getting bad my husband was getting ugly breaking things in the home trying to force me out of the home..he piled my clothes be the front door..I called the cops out a few times and finally one time they finally took him in on a warrant for a previous ticket. But they never filed a report for my calls...well now hes allowed me bak home cuz rent at apartments is getting to high and with the understanding that we are not working things out, more of a roommate type thing..yet now he's telling me he can't do this and wants me to leave..what can I do can he force me out considering we are still legally married. I want a divorce however I feel part of the home is mine as,well, we purchased after we got married. I don't feel I should be suffering by moving out and paying high rent when our marriage fell apart due to both our faults..please help

I don't know why you have waited so long to hire a lawyer, but you should do it immediately. The house is community property, and only a judge can force someone out of their home. You can request temporary orders that allow you to stay, while the sale is pending, or until one party buys out the equity of the other.
