Legal Question in Family Law in Texas

I have been legally married for about 13 years but separated for about 4-5 years now. She kicked me out when we lived in NY and then I was in a shelter home until I was able to move on my own to Texas. I have since moved on and want to remarry but she doesn't want to sign divorce or let me see our 8 year old son. I need to divorce this woman ASAP since she makes my current life a living hell.

It makes a difference whether you and she ever lived together in Texas. You didn't say where SHE lived.
