Legal Question in Family Law in Texas

Liabilities for his debt before us

I've been living with a man the last 5 years. We decided not to get married because he has a large IRS problem that he won't deal with. He also is involved in some civil suits against the company he works for. He doesn't take care of his business well enough for me to marry him. I'm not sure where I could be held liable.

We found a house that we had to have. In order to qualify we were told we would have to do it as a couple. We applied as married and the house is in both our names (using my maiden name-his last name). I'm assuming that makes us common law married now.

My concern is that if the IRS gets ahold of him or he gets judgments from these suits they will attach to our house or the little bit of money I had before we got together.

I love the SOB and don't want to get rid of him. How can I protect myself. He isn't going to deal with this stuff and I've accepted that. Can I get him to sign a quit claim deed for the house and file for divorce? He has a court date next week. Will it even matter if I file? I'm between a rock and a hard place here. Not to mention he has a 5 year old I'm crazy about and I've had from his birth.

help me please.
