Legal Question in Family Law in Texas

Life insurance Beneficiary

I have a medical problem and I want my son as a beneficiary to my life insurance; but his marriage is on the rocks. How do I protect the money designated to my son from going to his ''not soon enough ex?''

Re: Life insurance Beneficiary

In general, money received as an inheritance, if it is kept uncomingled (separate) from community funds, is considered separate property not community property and the "not soon enough ex" should not have a claim to it.

You need to an attorney who can explain your options to you.

Re: Life insurance Beneficiary

Ms. Bushman is absolutely correct.

Just tell your son to keep the proceeds in a separate bank account and not to commingle the funds in a joint account.

Better yet, establish a trust in your will (with your son the beneficiary of the trust) and designate a trust as the beneficiary of the life insurance policy.
