Life Insurance Proceeds

In Texas - husband files divorce papers and changes his life insurance beneficiaries to his children only. He dies before the divorce is final. If there were no stipulations, clauses, or anything of a legal nature preventing the change in beneficiaries, can the wife still claim the proceeds because of the premiums being community funds.

Interesting question. You should hire a lawyer. There is a very old case (1936?) that still upholds the original beneficiaries based upon the community estate.
