Legal Question in Family Law in Texas
Lifetime ban on adoption?
We are currently fostering 2 children
and parental rights were recently
relinquished. We had hoped to adopt
them but have been told my
husband has an adoption ban on him
for life because of a felony he
committed and was convicted of at
age 18 (intoxicated manslaughter).
He has completed his sentence
which was 10 years probation. The
offence was committed in 1995. Is
it true he can never adopt? Instead
of adoption we will do permanent
managing conservatorship.

Re: Lifetime ban on adoption?
I don't know who told you that. The key test for an adoption or any action concerning children is what is in their best interest. Your husband has paid his debt to society; and while this record must be disclosed, it should also be disclosed what he has done since that incident to attempt to make amends for his past. None of us are perfect, but you and he can make a family for these children, most courts would not stop such an adoption.
