Legal Question in Family Law in Texas
limitations on arrears
my uncle has 2 kids in texas & he lives in california. the kids are now in their early-mid 20's, but out of the blue his wages are being garnished for child support. my question is why after over 15+ years is the AG garnishing his wages. the arrears are some where around$100,000. what can my uncle do?

Re: limitations on arrears
Without knowing more information, I can only guess that within the statute of limitations, the AG got a judgment for the arrears, and has now located him, and is now collecting on the judgment. He should collect a copy of the file, and retain a Texas attorney to review the file for an opinion.
Re: limitations on arrears
If he was ordered to pay child suport and did not, then he will pay it until it's paid in full.
The good news is since the kids are over 18, he can't go to jail.
They will take his tax refunds and the money out of his bank accounts.
The debt is NOT dischargeable through bankruptcy.
He might also lose his professional license, driver's license and passport.
They will take $$ out of his social security check when he begins to receive social security.
When he dies, they will probably go after his estate too.
