Legal Question in Family Law in Texas

I live with my boyfriend and we're getting seperated. There is a baby involved and he has agreed to leave the baby to me without fighting for him as long as i don't keep him from him. I want to leave his apartment but I don't know if he can then say that i left with his baby. What can I do? How can I proof later on that he came into an agreement of leaving me the baby?

This is a serious situation and you should consult with an attorney.

You can get an agreement in writing with your boyfriend.

I suspect there are a lot or important facts that you didn't list in your question so it is difficult to assess you situation. You need to talk to a lawyer.

Good Luck!

If you leave, take the baby with you. If you don't, he can file for custody of the child. The burden would then be on YOU to prove why you should have custody of the baby.

Any verbal or written agreements -- even notarized -- are not binding on the judge!

If you want a consultation, I charge $1 per minute. Most last 2 hours -- $120 total.

Based on what you have written, you need to take your child with you when you leave. Either you or the child's other biological parent can file an action in Court to establish child custody, support, and visitation. You should seriously consider consulting with a local law firm to assist you with protecting your rights and interests. If my local law firm can assist you with this legal issue or any other legal matter, please contact us at [email protected] to arrange for an initial consultation.
