Legal Question in Family Law in Texas

I live in Texas and December 26, 2007 my then husband gave me a car as a gift. He had just got back from Iraq and I was gonna need my own car to get to school and get our daughter around. 2 months later he asked for a divorce and it was final September 2008. It was in the decree that he pay child support and I take over the car. He continued to pay for the car until it was paid off last year and I didn't ask for or receive child support during this time. Anyway, now whenever he gets upset he threatens to take my car from me. Can he?

The short answer is no - it's in the decree.

Is the title in your name? It should be. If it is, then it is clearly your vehicle.

If he was ordered to pay child support then he still owes the child support. If he threatens to take the car, then tell him that you will "enforce" the past due child support plus the 6% interest that he owes in the child support. That should scare him!

Child support is the debt that never goes away. His estate will owe it when he dies!

You might want to talk to a family law attorney in your county. He still owes this debt.
