Legal Question in Family Law in Texas

I live in texas and am trying to get a divorce. Not long after my husband and I seperated I began a relationship with someone and we ended up having a child together. My ex husband signed the denial of paternity but it apparently wasn't not filed right with the vital statistics and I can not get a certified copy of it to establish legal paternity and my exhusband will not go and refile the denial of paternity. My question is will the courts in texas accept a dna test done through the attorney generals office in place of a denial of paternity so I can proceed with the divorce?

I would encourage you to hire an attorney since you have a complicated divorce. As you have learned, your husband is the presumed father of this new child. And, the TX A G office is also going to probably be involved in your divorce.

Look on this website and on www.avvo.com for an attorney.

Good luck!

Also, congratulations on your new baby!
