Legal Question in Family Law in Texas

I live in Texas. My godson lives in Iowa with his mom. She is currently awaiting a competency hearing. Can she assign me temporary custodial care prior to the hearing?

Perhaps. Depends on her current status and what dad's story is. I would expect IOWA law to prevail on this issue if the child has been living in IA for more than 6 months, so you might want to redirect this question to IA attorney's. If she has sole custody or if dad is out of the picture, I wouldn't think there would be a problem with her sending the child to live with you. She could sign a "Non parent relative authorization agreement" that would allow you to take care of the child. You don't need an attorney for that (although I would consult with her IA attorney before taking any action). I have included a link to the State of Texas form regarding that authorization agreement I mentioned. Follow the instructions E X A C T L Y and you will not need an attorney to handle the paperwork for you.

Good luck!!
