Legal Question in Family Law in Texas

I live in Texas & my husband and I are currently separated. We have one 14 month old child who lives with me, am I able to put him on child support even though we are still married? Also, if he is not currently working does that mean that I am unable to file child support on him?

If you do not want to file for divorce, you can file a Suit Affecting Parent-Child Relationship. If he is unemployed, judges here will generally assess child support based upon minimum wage.
