Legal Question in Family Law in Texas
I live in Texas. I have been married for 19.5 years. I need to get a divorce. Most of our wealth is in blue chip stocks that are only in my husbands name He had these stocks when he was a child. Does that mean I am not entitled to any of it? What about the interest it accrued during the years of our marraige? All the dividends are being reinvested.

Generally, the actual stock that he owned before marriage is his separate property and the judge cannot take that away from him. The interest and most dividends are community property and belong to you as much as him. If he cannot prove what is separate, it is all community. If he sold stock and bought other stock during the marriage, he might not be able to prove what is his. The NAME that the stocks are in does not matter, only when they were acquired.
