I live in Texas and have had possession of my granddaughter for about a year. What steps can my daughter and I take to protect this situation without going to court?

Unclear what your question is. You cannot have legal custody without a court order; your daughter can. The daughter's father has the right to possession of the child over you. If the father seeks to take the child, you will have a hard time keeping the child from him.
