Legal Question in Family Law in Texas

I live in Texas and have shared custody with my daughters father, most of the time she is happy to go when it is time for his visits. But at what age can she decide? She will start school soon and start extra activities such as girl scouts that she will have to miss functions when she is at her dads. He would be unable to take her because we live three hours away from each other. And due to his work schedule and distance there is no real way for us to make up days that his would miss.

She can decide when she is 18 years old. You are going to have to be realistic, that in this type of situation, there will be compromises. Even your daughter, who played no part in your divorce, will have to compromise. You need to negotiate some flexibility with her dad, so that she can participate in school activities, and he can still see her regularly.

If you can't work this out, you will either have to mediate it, or take it back to the judge to decide. These situations are going to occur regularly until she is 18, and litigating every situation is not healthy for your daughter, and will anger the court.
