Legal Question in Family Law in Texas

We live in Texas, My son has a 5 year old daughter now who lives with her mother. They have never been married. My granddaughter has a speech defect. She went to school for a year at age 3 when she was living with my son under a special ed program. Her mother kept her out of school last year when she was with her. She turns 5 on Aug 28. I know the law in Texas doesn't require you to send your child to kindergarden, but what about a child with special needs? Can the mother be forced to send her to school to get speech therapy or obtain it privately so the child gets help? What can my son do? There are no custody papers. Isn't this neglect if the child has a need and the parent won't do something about it? Does a grandparent have a way to get speech therapy done?

If there is no court order regarding this child then your son needs to file for paternity and establish his rights.

I do not recommend going to the TX A G office because they will only address your son paying child support - they don't care if he gets to see the child or if the child is in school.

I highly recommend that your son meet in person with an experienced family law attorney about his options. It appears that he lives in Harris County. There are many fine attorneys in Houston. Look on this website & on www.avvo.com for an attorney.
