Legal Question in Family Law in Texas

I have lived with my boyfriend for over 4 years. He proposed to me 3 years ago, but we never set a date. Most of our family & friends are aware of this. Just recently he has become very jealous & he has asked me to move out. I know he has a lot of financial problems, he has filed bankruptcy & he owes the IRS lots of money. I know he is very stressed over the financial prob.

What rights do i have in this relationship? Are we considered common law married? If so, can he make me move? What rights do I have? if any.

Did you have an agreement to be married to him (in the PRESENT TENSE, that is, "Let's agree that we are NOW married")?

Have you represented yourselves to others as married?

Have you filed income tax returns as husband and wife?

If not, there is no informal marriage (often referred to as "common-law marriage").

The applicable law is section 2.401 of the Texas Penal Code.

The question about him having the right to make you move is another matter. We would need information about your lease.
