Legal Question in Family Law in Texas

long distance visitation for toddler

My husband abandoned my son at 9 months. At 2 years of age, I moved him to MT so he could get to know his son. I have decided I want to move back closer to my family. We are not divorced at this time but are looking to come up with an agreement. My son has not spent more than 5 hours with his dad in the last six months. What kind of a long distance visitation schedule is appropriate at this age (2.5 years old) and over 1500 miles apart?

Re: long distance visitation for toddler

Since it sounds like you have been living in Montana for at least 6 months so your residence is Montana and the divorce will need to be done there. You will need to talk to a Montana family law attorney and find out what the Montana guidelines are for long distance visitation of children under three.

A divorce that involves children, particularly young children, is not a DIY project. You need an attorney.
