Legal Question in Family Law in Texas

How long do you need to be a resident in Texas before you can file home state for your child if you used to live in Oregon? Does this process need to go to court or is it just the filling of papers.

Thank you

Six months.

I'm assuming that (1) you have the legal right to determine the child's residence and (2) your prior order doesn't have a geographic restriction limiting you to the state of Oregon.

And you don't need to file any special papers. Texas becomes the home state by virtue of the fact that you and the child have lived here for six months.
