Legal Question in Family Law in Texas

How Can I Lower Child Support Payment

My ex-husband has had my wages garnished at $450.00/month. I only make $1,600/month and filed bankruptcy in September, 05. I'm barely making ends meet now - this amount will destroy me. My ex-husband makes very good money (6 figures)and lives in a 5-bedroom house with his wife. Our daughter is 17. I live in a 1-bedroom apartment and have not re-married. He doesn't need the money and I can't afford it.

Re: How Can I Lower Child Support Payment

You'll have to go back to court with a motion to modify the child support amount. This is not as easy as it sounds and you should get an attorney.

What the father makes is irrelevant.

It is the policy of the State of Texas for BOTH parents to support their children to the best of their ability.

The money is NOT going to your ex, it's for the expenses related to your minor child. Expenses such as electricity, gasoline to drive her places, water, food, shelter, etc.

If he made $0 a year and you made $1 million, then your child support would still be based on what you made.
