Legal Question in Family Law in Texas

I want to know if I can make my husband move out of the house we rent. He is on the lease, but I always make the rent. He is verbal abusive to my son and me. I was unemployed for 6 months and just got a contract job that will eventually go permanent. I do not have the funds to move my son and me.

You can file for divorce and, in your original petition for divorce, ask the court for a hearing on temporary orders. At the temporary orders hearing, ask the court to grant you temporary exclusive use and possession of the apartment.
