Legal Question in Family Law in Texas

If the managing conservator(mother) no longer has the child with her and she has been arrested 3 times since she became the managing conservator and has a suspended license and no permanent address -no job status -- My question is: as the father and the possesory conservator of the child what rights to I have - Can I bring the child to live with me since she is no longer living with the mother - What process needs to be taken/

You need to file a legal document and ask the court to name YOU the managing conservator of the child.

Since you are the other parent, you are PRESUMED to be the next person in line to be named the MANAGING CONSERVATOR.

If the child has been living for more than 6 months with someone else, that person can ask the court to name them (EVEN A NON-RELATIVE!!!) the managing conservator.

Therefore, you need to do something IMMEDIATELY!
