Mancipation

I have a niece that will turn 17 in two weeks. She want to leave her mothers haouse but the mother says that she can pressmancipation charges on her. Is this true and what is the law say for a 17 year old leaving home?

Emancipation is a legal process where a minor becomes an adult in the eyes of the law. If the mom and dad and child want to agree to emancipation, then it is a straightforward proceedings.

In Texas, 17 year old is a minor, without the capacity to sign legal documents, and is not treated as an adult until they are 18.

She has to be in school until she is 18, graduated or GED.

However, a 17 year cannot be charged as a runaway. If the police are notified of her residence, then they will not take a missing persons report.

If there are any outstanding court orders regarding her conservatorship or conduct; then there may be a judge out there with the authority to determine her residence, at least until she is 18.
