Legal Question in Family Law in Texas

Marital Relations

Couple married 10yrs. Husband out of work most of marriage because of back injury. Intimate relations between husband and wife have stopped. Major religious differences arisen over course of marriage. No affair suspected either side. Wife just stopped relations. Couple has 2 kids. Wife working, but not good with money. He has talked to the wife re the intimate relations on multiple times for multiple years and nothing has changed. Would this be grounds for divorce? Can husband possibly get custody or even joint custody of kids? My question is what are the options of the husband?

Re: Marital Relations

Texas has "no fault" divorce where the marriage has become insupportable because of discord or conflict of personality that destroys the legitimate ends of the marriage relationship and prevents any reasonable expectation of reconciliation. It seems to me that you meet those requirements. If the husband has been the primary caretaker of the children (while the wife worked) that can be a significant factor in the custody determination. Is there a social security disability or other medical determination of inability to work? You can check out the family law page on my web site http://www.reasonable-doubt.com but you should find a family lawyer near you.
