Are marriage counselors bound by patient confidentiality in a divorce and custod
I went to see a psychologist to discuss my problems in my marriage. Later, my husband started seeing the same therapist. Now I have filed for divorce and I am afraid it is going to get nasty. My husband has threatened that he is going to subpenoa my psychologist and her therapy notes into court against me. Can he do this? I thought this was protected by patient confidentiality laws.

The client-patient privilege certainly protects you with a psychologist, and it would most likely be a breach of this privilege for the psychologist to disclose any information about you or your husband. To be safe, I strongly urge you to discuss this with your attorney, but I think you should not worry about private issues being divulged to your doctor.
