Legal Question in Family Law in Texas

Marriage and Divorce

My father has been doing some shady things with my mother and I want to know if there is anything the law can do to help out my mother.

Several months ago, my father told my mother that he wanted to get a divorce. Every month my dad would send my mother money so she can support herself. It is only recently that he STOPPED sending money. My parents are technically still married, the court date is not set until 2 months from now. My mom has never had a job.

My brother is 22, I am 19 and my sister is 17. Part of the reason why the date is so far away is because he does not want to pay child support for my sister. He assumed that it would be better to wait until she is 18.

My sister knew the password to my dad's e-mail. This is what she read:

1. He has been cheating on my mother for months.

2. He already proposed to his girlfriend for marriage, bought her a ring and everything.

3. He opened up several secret bank accounts under different names to deposit money. He did this so that when it is time to split the money, my mother will only get a small portion.

What are your thoughts? Is anything that my father doing illegal? Can these e-mails be used in court againts my dad? Some help would be great.

Re: Marriage and Divorce

Your mother needs to take this information to her lawyer. If she does not have one, she needs to get one.

The attorney also needs to discuss electronic privacy with her or your sister. Your sister may have committed a crime when she accessed the email account. The lawyer needs to know about that BEFORE he is told anything else so that he can be better prepared to protect them both.

Re: Marriage and Divorce

Your mother needs to hire a good family law attorney and get some temporary orders in place now. If you're in the greater Houston area feel free to have her call my office and set up an appointment. Good luck!
