Legal Question in Family Law in Texas

Is a marriage legal

I was married in the state of Texas almost 9 years ago. I have been seperated for 7 years and just found out that our marriage license was never filed at the court house. And know one has a copy. Does that mean it was never legal? I am wanting to get remarried and need to know if I have to get divorced or not. Please help.

Re: Is a marriage legal

Most likely, you are married. I understand the only thing lacking to be the filing of the license after the ceremony. FYI, by statute, the clerk's office is supposed to keep a copy of all marriage licenses, both issued and executed.
