marriage problems with child
i have a sister who wants to leave her husband but they have a 3 month old together. he told her that is she leaves he would find her hurt her. what can she do with out getting in trouble if she takes the baby. can she take the baby?

Please help her hire a lawyer. An attorney knows how to file pleadings so that a restraining order is in place immediately, so that she is protected. She has the right to leave with the baby, but if the pleadings are filed with the court, then he will have to keep his distance until the court hearing.

Just another alternative to Ms. Langford's capable suggestion. She should get a protective order. She can apply at the local DA's office if she considers the threats of physical violence to be real and fears for her physical safety. That's all that's required. She doesn't have to show up with bruises. This is a free service and will prevent him from coming close to her for 6 months or be arrested.
