Legal Question in Family Law in Texas

marriage in Texas

Here's the situation: Stepfather adopts stepdaughter, and later divorces her mother. Even later, the man that adopted her daughter wants to marry that daughter (now an adult). If the adoption had never occurred, they could. But now, they are legally father and daughter and do not wish to remain so. How do they void the adoption? Both are consenting, nonblood related adults. Perhaps if another man adopted her in an adult adoption, leaving the original man free from parental legal rights to her, then could the two of them get married? Or would that even be necessary? What if they want to declare an informal marriage - could they do this in Texas without even messing with the adoption laws? Please help - I have done all I can think of to get this question answered and it is very important to me.

Re: marriage in Texas

You are wanting to circumvent some very basic laws, and I don't think that you can. Retain an attorney to do some long and complex research to determine if it is possible.
