Legal Question in Family Law in Texas

I am married and have one child. My wife and I were separated for a short period during this time I had an affair. My wife and i have reconcilled. The other woman has served me with child support papers. I was never told she was expecting. The child is one year old. As a father what are my rights? Can I legally give up rights to child? If so, am I still responsible for child support?

The fact that she never told you that she was expecting is generally irrelevant. If you are the father, you will have the rights and duties assigned to you by the court, including the right to possession of the child and the duty to pay child support. The support can be retroactive top the birth of the child and could include medical expenses relating to the birth. you could even be made the primary conservator of the child if the circumstances were right.

You cannot just voluntarily give up your rights. A court can terminate them, but that is unlikely.
