Legal Question in Family Law in Texas

I was never married to my child's father. We lived with him in California until 7 months ago, when I brought my child with me to live in Texas. He wants to see her for the summer, and I am inclined to allow her to go. There is no court order regarding custody, though there is a pending case for me to receive child support in California courts. If I let her go without having a court order for custody, do I have any legal recourse if he won't send her back when the visit is over? I cannot afford an attorney, and the filing fees to file the SAPCR would really put a dent in my bank account.

The short answer is no. If there are no court orders than either parent can keep her.

So you need to talk to an attorney in your county.
