Legal Question in Family Law in Texas

I married my husband last year january 0f 2009 right before he left for deployment in the military. we later found out that i was pregnant. i had a little girl in sept 2009. my husband just recently returned from iraq and does not want to be with me. he has over 20 grand saved in his personal bank account and i only have a few dollars to my name. i told my husband that if he doesnt want to be with me then i want a divorce and he threatened me saying if i got a divorce that he would put all his money into a lawyer and take our daughter away from me. i dont have any money to afford a lawyer, what can i do?

Just because you think you can't afford a lawyer doesn't mean that you can't.

If your husband got the money while you were married, it is community property and half of it belongs to you. Also, the court can award you court costs and attorney's fees and your lawyer can get paid that way.

Look for an attorney who can work with you.

It looks like you live in Houston. I would call PATRICIA BUSHMAN at 713-807-9405 and talk to Jessica in her office. Tell her that FRAN sent you. I'm not taking cases because my mom's been ill.

1. Quit listening to him -- he is NOT properly stating TX laws.

2. Talk to an attorney and find out your rights immediately

3. If he's military, I doubt that he will get custody since he can be deployed at any time. He would have to prove you unfit to gain custody.

4. Any money or assets acquired during the marriage (unless inheritance or it was his separate property before marriage) is community property. That means 50% is yours!

5. If I were you, I'd call Pat Monday morning.
