Are we really married

My husband was married before, about 8yrs ago. His wife and him have been seprated for 3yrs. She sent him divorce papers, he filled them out had them notaried and sent them back to her. We assumed she filed the papers with the court. We got married, and after 3 yrs of being married she calls us and says she never filed the papers. We have not refiled or anything. So is he still married to her. Are we legally married. We have been "married" for 5 yrs now. Can you please help.

I hate to tell you this, but your husband may still be married. If the divorce was never finalized, the marriage may still exist. There are a few exceptions that may apply to a common law marriage.
