if i am still married and we have kids but we are not togather is it legal for me to take me kids if i have a place to stay for me and my kids sense she doesnt even if its out of town or state

I think you definately need to meet with an attorney in person.
Generally in Texas if there is no court order, either parent can have the kids. However, Texas won't lose jurisdiction over the children for 6 months.
For example, if you leave December 15, she can file in Texas for 6 months (say June 15, 2010) and TX will have jurisdiction over you and the kids.
If you are moving out of state, I don't know how long it will take for the new state to have jursidiction over you and the kids. I would check before moving. Many are 6 months but it could be one year.
