Legal Question in Family Law in Texas

I'm currently married for 15 months and my husband wants me & my daughter to move out into an apartment and get a divorce. He is rushing me to move out immediately. I am currently not employed by his request for me to be a housewife. What part of paying for my housing and living expenses is he responsible for? I have an 8 yr old daughter who lives with me full-time by a previous marriage. I don't have money for an attorney...I'm not sure where to begin.

I would strongly suggest that you DON'T move out. Ask him why HE doesn't move out and get an apartment.

If a divorce is filed (by him OR you), make sure that it includes a request for temporary orders that will require him to support YOU (temporary spousal support) and the child (temporary child support).

I assume that you don't want to stay married to him.

Your best bet would be: Figure out a way to come up with some money to hire a lawyer (I'd scrape up about $2500, even if it meant borrowing from relatives). File for divorce, and do NOT move out. In your petition, ask for temporary orders that will award to YOU temporary exclusive use of the house. After the hearing on temporary orders, assuming that the Judge does award the use of the house to you, your husband will be given a reasonable amount of time to move out.
