Legal Question in Family Law in Texas

I am married to an older man with children from other wives. When we married we bought a house together and have been married for ten years. I was told that if something happened to him I will have to lose my house because the chilldren will make me sell it to get their father part of the house. I would like to know will I lose everything to his children?

The answer is you need to talk to an attorney that specializes in estate planning.

You probably have a "life estate" in the property but a life estate is far to complex to discuss in this small space.

Plus, if he writes a valid will and leaves you the house then you have nothing to worry about.

However, you won't lose "everything" since you own 1/2 of the house and 1/2 of the community property since you have been married for 10 years.

But, since I've seen many bad things happen when one spouse dies or becomes seriously ill, I highly recommend that you consult with an attorney NOW so that you understand what could happen if he comes ill or dies.

Please make an appointment now with an attorney.

Since it appears that you live in Harris County, I highly recommend W. Kevin Alter at 713-526-2333. His office is at 2020 SW Freeway, Suite 225 in Houston TX 77098. I've used him personally & I recommend him to my family & friends. His prices are reasonable. He explains things in language that you can understand.

Please tell him that FRAN sent you.
