i got married in the philippines and now i currently reside in texas with an h1b visa. i have a 5 y/o old son who is living with me and is a citizen. i want a file a divorce with my husband who is in the philippines right now. how i can i do this? and how much will it cause? thanks

To file a divorce in texas you must be a resident of the state for 6 months and a resident of the county where you are filing for 90 days. If you meet these requirements you can file for divorce in Texas.

As your situation is more complex that most, you should retain a divorce lawyer to represent you. Since your husband does not live in the U.S. and does not appear to be a U.S. citizen your lawyer is going to have to help you obtain service upon him. This problem will make your divorce a bit more expense and time consuming.

Once your husband is properly served, if he does not file an answer, the matter should be straightforward.
