Legal Question in Family Law in Texas

I was married for 20 years, but we have not lived together for 6 of those years. I have filed for divorce and the home is currently still under my name as well as my wifes name. Can I force her to sell the property to remove me from the obligation with the mortgage company?

You can ASK the court to order the sale of the home (in connection with the divorce).

In the alternative, you can ask your wife to refinance the house in her name only (ask ehr nicely, and offer to give her lots of extra property in the settlement agreement).

You can also have a decree that requires her to refinance AFTER the divorce, but the problem is: What do you do if she CAN'T get it refinanced (that is, all the lenders say No)?
