Legal Question in Family Law in Texas

I have been married for 14 years and would like to open our marriage up. My husband is alright with it, but I am afraid it will hurt me if we ever divorce in getting full custody of our children. Could we write up something stating that we both agree to an "open marriage" and that it will not interfere or be brought into a custody agreement should one ever come up? I don't want to be the one that "cheated" and that count against me at some point.

The court will take into account everything that affects the "best interests of the children." No matter how many agreements that you make, if the court believes that one parent's behavior is bad for the children, then that will matter.
