Legal Question in Family Law in Texas

--------------------------------------------------------------------------------

I married a illegal immigrant, and we are now separated. We have a daughter together, and I am currently paying child support. We live in the state of TX. I am wanting a divorce but I am worried that she will then take my daughter to Mexico. Is that possible?

It is possible, but you can take steps to prevent it.

First, apply for a passport for your daughter. Once you get the passport, file for divorce and ask for an ex parte TRO removing the child from the other parent for fear of international abduction (if you have facts to support such an application) and asking that the child not be allowed to leave the state during the pendancy of the matter.
