Does he have any rights?

In Texas the legal term for common law marriage is informal marriage. An informal marriage is a relationship where you agree to be married, live together in Texas,as husband and wife, hold yourselves out to other as husband and wife. You must both be eligible for a marriage license.
If you want out of an informal marriage, you need a divorce. To get a divorce from an informal marriage you would need to prove the informal marriage.
