What is the meaning of common law marriage? Do you have to get a divorce? My son has lived with his wife (common law) for

14 years, they have 2 children, they have a home paid for, she moved out and said he could rent it for $ 2,000.00 a mo

Does he have any rights?

In Texas the legal term for common law marriage is informal marriage. An informal marriage is a relationship where you agree to be married, live together in Texas,as husband and wife, hold yourselves out to other as husband and wife. You must both be eligible for a marriage license.

If you want out of an informal marriage, you need a divorce. To get a divorce from an informal marriage you would need to prove the informal marriage.
