Legal Question in Family Law in Texas
mediation agreement signed/let go of lawyer
My mediation session is scheduled for Jun12, 07 and my lawyer signed some kind of agreement to have this done by Jun15. We are not prepared at all, he's not sure if he can postpone it. I feel like he's not look out for my best interest. I tried to talk to different lawyers about my situation, but they can't see me because I currently have an attorney due to conflict of interest. Is it too late to let my lawyer go and get a different one? Can he postpone the mediation even though he already signed the agreement? I'm currently received child support, and my husband is helping with 1/2 of the credit card debts and the vehicle's payment. We do not have tempo spousal support in place, my lawyer feels like we wouldn't get more because everything is based on the judge's mood. Does my husband responsible for 1/2 of the house and everything regardless of how much I make or he makes until the divorce is final? he was the one who abandon me and our 2 kids. Thanks so much for your help.

Re: mediation agreement signed/let go of lawyer
Although it certainly happens, ethical attorneys cannot discuss the merits of your case or the situational details while you are represented by another attorney. You can consult with other attorneys as to their qualifications, and make a determination if you wish to hire them. If you wish to hire a new attorney, then a sustitution of counsel is appropriate. There is no way to know in advance if the mediation can be postponed.
