Legal Question in Family Law in Texas

Medical Support in Texas

My husband is the NCP. The CP was ordered to provide medical insurance since it was cheaper through her job. Husband was ordered to reimburse for about $100 a month. Then, CP changed jobs, tripling her premium cost. She and H agreed (verbal, I know) that I would place stepdaughter on my insurance since coverage is better, i am paying for it anyway because I have my daughter on it anyways. I added stepdaughter, provided card to CP and she reimbursed my husband for the 1st month. after that she played it off, ''don't have money, don't have checks'' till she finally told him she had a lawyer and that it was ultimately his responsibility. we know that, but the court order says SHE provides, HE pays. right now HE provides AND he pays. Is there anyway he could get that money back if they ever do get a review. he would have to wait 2 more years to get a review and they denied one to try to change it over to him on the basis that it hadnt been 3 yrs. Stepdaughter is covered until september 1st. SHould i renew it anyway and let her screw my husband financially? or do i keep her and then just present 2 yrs from now that he had been paying all along? As a lawyer, do u think there is any way that my husband can recover or get credited for that$

Why not just modify the court order to reflect the reality of what you are doing?

I'm guessing by "review" you mean something to do with the AG's office. You can't depend on them to do anything, at all, any time, any where to help you in the leastest. Get your own lawyer and get the order modified to reflect reality. If your H is paying be sure and keep all stubs or checks and ask for a reduction in the child support for the double payment period. Be aware however that this action could possibly result in a child support increase if your H is making more money than in the original order. Still accuracy would be in your long term best interest.
