Legal Question in Family Law in Texas

mental cruelty as ground for divorce?

my husband told me he wanted to end our marriage a month before my baby was born. He was told that the emotional distress he was putting me under could harm me or the baby but he did not care.

Is it possible to file for divorce accussing him of mental cruelty during my last months of pregnancy and after the baby was born?

You can file on any grounds you want. Whether it's to your advantage to or not is a different story. You should sit down and talk with a good family law attorney. You're going to need one for the divorce. A divorce with a child under the age of three is not DIY.
