Legal Question in Family Law in Texas

I met a man in federal prison and we have become very close and want to be married. His wife testified against him and is now in the witness protection program. Does he still need to file for divorce so we can be married. Can we just file under abandonment laws. There is no one to serve. They were married in Texas.

If he hasn't gotten a divorce, then he is still married to his wife. He has to divorce her before he marries you.
