Legal Question in Family Law in Texas
I am in the middle of a divorce/custody case for three yrs now,we are close to our final court trial. I am from California all my family is there, came to texas with him and have been stuck here due to custody of our daughter we adopted. I want to go home, due to the fact my daughter had an injury in his care I wont let him see her alone. He had vistation with our temp
order. My attrny has told me before she thought he could harm me, and most recently he had a bench warnet from the judge when it came out he told my attrny he would end his life if he lost Molly. He has threaten endinghis life for yrs. Now my attrny says she fears he would kill Molly and himself. Due to this I would love to go back to California for my safety and Mollys. But How can I do it legally. im here in texas with noone to even know if he did anything to me.
Please is there anyway I can go home and get orders in california afterward.Without being called a kidnapper. thank You.

If there are court orders in place regarding your daughter's residence, then you cannot violate those orders - it will certainly affect your conservatorship. You have an attorney who has been taking care of these issues for three years - these are questions to direct to your attorney. In a case clearly this complex, only your attorney can effectively advise you.
